Terms of Use
Effective date: September 3, 2026
1. Acceptance of Terms
By creating an account, accessing, or using CarShow Manager (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Jeff Jack ("we," "us," or "our"), the operator of CarShow Manager. We reserve the right to update these Terms at any time, as described in Section 16.
2. Description of Service
CarShow Manager is a platform for organizing car show events, managing vehicle registrations, conducting QR-code-based attendee voting, and generating winner certificates. The Service includes web-based tools for show organizers, public-facing registration and voting pages for attendees, and administrative dashboards for managing events. Features may be added, modified, or removed at our discretion.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service as a show organizer. Attendees who vote or register vehicles at car shows may be of any age, but individuals under 13 should not provide personal information without parental consent. By using the Service, you represent that you meet these eligibility requirements.
4. Account Responsibilities
You are responsible for maintaining the confidentiality and security of your account credentials. You are responsible for all activity that occurs under your account, whether or not you authorized it. You agree to notify us immediately if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. You may not share your account credentials with others; instead, use our collaborator invitation feature to grant access to specific shows.
5. User Content and License
You retain full ownership of all content you upload to the Service, including show details, logos, descriptions, car entry photographs, and other materials ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, process, and transmit your content solely as necessary to provide, maintain, and improve the Service. This license terminates when you delete the content or your account.
You represent and warrant that you have all necessary rights to upload any User Content you submit, that your content does not infringe the intellectual property or other rights of any third party, and that your content complies with all applicable laws. You are solely responsible for the legality and appropriateness of User Content you submit.
6. Acceptable Use
You agree not to use the Service to:
- Conduct fraudulent voting, stuff ballot boxes, or manipulate event outcomes
- Submit false or misleading vehicle registrations
- Upload illegal, obscene, defamatory, or infringing content
- Attempt to circumvent anti-fraud measures including geofencing, device fingerprinting, or one-phone-one-vote enforcement
- Use automated scripts, bots, or crawlers to interact with the Service without written permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
- Impersonate another person or entity, or misrepresent your affiliation with a person or entity
- Harvest, scrape, or collect personal information of other users without their consent
- Use the Service for any purpose that violates applicable local, state, national, or international law
We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including suspending or terminating their account without notice or refund.
7. Voting Integrity
CarShow Manager employs multiple anti-fraud mechanisms to promote fair voting, including GPS-based geofencing (restricting votes to attendees physically present at the venue), device fingerprinting (one phone, one vote), and last-vote-counts policies (if a voter changes their mind, only their final selections are tallied).
While we make commercially reasonable efforts to prevent duplicate or fraudulent votes, we do not guarantee that every vote cast through the Service is legitimate. No anti-fraud system is infallible. Show organizers are ultimately responsible for the integrity and oversight of their events. We disclaim all liability for voting irregularities, disputed results, or any damages arising from reliance on vote tallies generated by the Service.
8. Intellectual Property
The Service, including its original code, design, features, functionality, documentation, and branding, is and remains the exclusive property of Jeff Jack and is protected by copyright, trademark, and other intellectual property laws. "CarShow Manager" and its associated logos are trademarks of Jeff Jack. You may not use our trademarks without prior written consent. Nothing in these Terms grants you any right to use our intellectual property except as expressly stated for accessing the Service.
9. Subscription and Payment
Certain features of the Service may be offered under paid subscription plans. Pricing, billing cycles, and feature availability will be communicated at the time of purchase. You agree to provide accurate billing information and to keep it current. All fees are non-refundable unless otherwise stated or required by applicable law. We reserve the right to change pricing with 30 days' notice to active subscribers. Free-tier accounts may be subject to usage limits.
10. Service Availability
We strive to maintain the Service at high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, server failures, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime, including during live car show events. We recommend that organizers have contingency plans in place for critical events.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR ITS INFRASTRUCTURE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
13. Indemnification
You agree to indemnify, defend, and hold harmless Jeff Jack and the Service from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) User Content you submit through the Service; or (e) any voting disputes, event outcomes, or claims arising from events you organize using the Service.
14. Termination
You may terminate your account at any time by contacting us at the email below. We may suspend or terminate your account at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. We may retain certain information as required by law or for legitimate business purposes as described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination will survive, including Sections 5, 11, 12, 13, and 15.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas. You agree to submit to the personal jurisdiction of those courts. You agree that any cause of action arising out of or related to the Service must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective date" at the top of this page and notify registered users by email at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service and may request deletion of your account.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
18. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and us regarding the Service. They supersede all prior and contemporaneous agreements, proposals, and communications, whether written or oral, relating to the Service. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
